1. Acceptance of Terms

By accessing or using the Site, you confirm that you are at least 13 years old (see also Section 15.5) and that you agree to be bound by these Terms. If you do not agree, please stop using the Site.

We may update these Terms from time to time (see Section 12). Your continued use of the Site after a change is posted means you accept the updated Terms.

3. The Estimator — Not a Quote

The Site includes an interactive estimator tool (“Estimator”) that lets you enter room dimensions and receive an estimated material cost. This section explains what that estimate means — and what it does not.

How the Estimator works. The tool adds a standard ~20% waste factor to your entered area to account for cuts, seams, and offcuts, and assumes a slab yield of approximately 45 square feet of usable surface per slab for planning purposes. These are industry averages. Your actual project will differ based on slab lot, edge profiles, layout complexity, material selection, and other site-specific factors.

The Estimator output is not a quote, not a binding offer, and not a contract. Figures produced by the Estimator are rough planning estimates only. Do not rely on the Estimator output for budgeting, financial planning, purchasing decisions, or any contractual commitment. A formal written quote — based on a site measure, material selection, and current pricing — is the only binding basis for any agreement between you and BlueBay Granite.

To the extent permitted by law, our liability for any loss arising from reliance on Estimator output is limited as set out in Section 10 of these Terms.

4. Quote Requests — Not a Contract

Submitting a quote request through the Site (via our online form) is an invitation for us to contact you. It does not create a contract, a reservation, or any obligation on either side.

A binding agreement for fabrication or installation services will only arise when you and BlueBay Granite have both signed a written scope-of-work agreement and you have paid any required deposit as described in that agreement.

5. Communications from Us

When you submit a quote request or otherwise contact us, you consent to receive email and phone responses related to your inquiry. We may also send you follow-up messages about your project for a reasonable period after your initial contact.

We comply with Canada’s Anti-Spam Legislation (CASL). Any commercial electronic messages we send will include our contact information and an easy way to unsubscribe. To opt out at any time, email info@bluebaygranite.ca with the subject line “Unsubscribe”.

6. Intellectual Property

Unless otherwise noted, all content on the Site — including text, photographs, graphics, logos, and software — is owned by BlueBay Granite or its licensors and is protected by Canadian and international copyright law.

You may view and print pages from the Site for your personal, non-commercial use only. Fair dealing for the purpose of research, private study, criticism, or news reporting is permitted to the extent allowed by the Copyright Act (Canada). All other reproduction, distribution, or commercial use requires our written permission.

We do not control third-party sites and are not responsible for their content, privacy practices, or availability. Visiting a third-party site is at your own risk and subject to that site’s own terms and privacy policy.

9. No Warranties

These warranty disclaimers apply to the Site and its content only. They do not affect any warranties BlueBay Granite may provide separately regarding its physical fabrication and installation services or products.

The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to the Site.

We do not warrant that the Site will be error-free, uninterrupted, or free of viruses; that any content is accurate or complete; or that the Site will meet your requirements.

Nothing in these Terms limits or excludes any warranties, conditions, or other consumer rights that apply to BlueBay Granite’s stone fabrication and installation services or products under applicable law.

Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act, 2002 (Ontario) (the “CPA”) or any other applicable consumer protection legislation that cannot be waived by contract.

10. Limitation of Liability

To the fullest extent permitted by law, BlueBay Granite (including its officers, employees, agents, and suppliers) will not be liable to you for any of the following types of loss or damage arising out of or in connection with the Site or these Terms:

In any event, our total aggregate liability to you for all claims arising out of or related to the Site will not exceed CAD $1,000 (one thousand Canadian dollars).

We may update these Terms at any time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will take reasonable steps to notify you — such as displaying a notice on the Site.

Your continued use of the Site after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the new Terms, please stop using the Site.

13. Termination / Access Revocation

We reserve the right to suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or if we discontinue the Site.

All provisions of these Terms that by their nature should survive termination will do so, including without limitation Sections 6 (Intellectual Property), 9 (No Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law).

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms or the Site will be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You consent to the personal jurisdiction of those courts.

Note on arbitration: We have deliberately omitted any arbitration clause or class-action waiver from these Terms. This is a brochure-style website; no transactional relationship arises from browsing or submitting a quote request. Mandatory arbitration clauses in such contexts are of uncertain enforceability in Ontario following Uber Technologies Inc. v. Heller (2020 SCC 16) and would not serve visitors’ interests. Disputes, if any, will be resolved through the Ontario court system.

15. Miscellaneous

15.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15.2 No Waiver

Our failure to enforce any provision of these Terms on any occasion does not waive our right to enforce that provision on a future occasion, nor does it waive any other provision.

15.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BlueBay Granite with respect to your use of the Site and supersede all prior or contemporaneous understandings, agreements, or representations.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Age Gate

The Site is intended for a general audience and is not directed at children. We do not knowingly collect personal information from individuals under the age of 13. If you are under 13, please do not use the Site. See our Privacy Policy for details.
